General terms of sales

Preamble

Green-ingredients.com (below called “Site”) is a site of information and e-commerce. It is produced by the French company GREEN’ING SARL with a capital of 5000 Euros, whose head office is situated in Hameau des Douze 34600 BEDARIEUX – France, registered on the Register of companies of BEZIERS under the number 804742609. You can contact GREEN’ING by calling +33 (0)6 62 49 61 62.

The site allows GREEN’ING (Seller) to propose in the sale of extracts and natural ingredients (products) to Internet users navigating the site (customers).

The customer wishing to purchase online via the site hereby formally declares that he/she has full legal capacity.

Article 1 – Purpose

The present terms of sale define the contractual relations between the seller and the customer as well as the conditions applicable to any purchase made by means of the site. These conditions apply for all the sales realized from this site, with the exception of any other conditions. Any order of a product proposed on the site supposes the consultation and the express acceptance of the present general terms of sale and the retraction. In particular, the customer noted that the acceptance of these general terms of sale does not require handwritten signature from him/her or that of seller. General terms of sale can be printed by the customer and consulted on the site. These terms of sale will prevail over any other general or particular conditions not expressly approved by the seller. The seller reserves the right to be able to modify its terms of sale at any time. In this case, the applicable conditions will be the ones current in the date of the electronic validation of the order by the customer on the site.

Article 2 – Products

The characteristics of products proposed in the sale are presented in the shop of our site. Photos do not enter the contractual field. The responsibility of the company GREEN’ING cannot be committed if errors got there. All the texts and the images presented on the site are reserved, for the whole world, in conformance with the rights of author and intellectual property; their reproduction, even partial, is strictly forbidden. Products are proposed in the sale until exhaustion of the stock. In case of order of a product become unavailable, the customer will be informed about this unavailability, as soon as possible, by e-mail.

Article 3 – Prices

The prices are indicated in Euros. They are inclusive of Value-Added Tax (VAT) at the rate applying on the date of the order. Any order placed on the site and delivered outside the European Union will be charged without the VAT and can be submitted to possible taxes, customs duties and other costs associated which are imposed when the parcel reaches its destination. These fees in addition are chargeable to the customer and are of his responsibility. The professionals of the European Union (off France) possessing one N ° intracommunity VAT do not pay the VAT as far as they communicate this number by e-mail at contact@green-ingredients.com. The prices indicated on the site are guaranteed in the day of the order while stocks last, and errors excepted manifest of typography or omission. The indicated prices do not take into account postal charges which will be charged in addition either offered according to the amount of the command and the country of delivery, and will be specified to the customer during the definitive validation of his order. These postal charges do not include customs and other associated coasts which can be asked the entry of certain countries, these coasts stay in the exclusive load of the customer. GREEN’ING reserves the right, what the customer accepts, to modify his prices at any time.

Article 4 – Registration and confirmation of the order

Registration of the order

If the customer wishes to place order, he will choose the various products and will put them in the basket. To order the products which he chose, once he has clicked on ” Proceeded with order “, the customer will have to become identified, by seizing his e-mail address as well as the password which he will beforehand have chosen during the creation of his account. If it is about its first order, he will have to fill with accuracy the provided him with form. Besides, the customer will have to supply his e-mail address and a password of his choice which will be personal and confidential to him and which it will need to become identified later on the site. Once the identified customer, he will have to validate the delivery address.

Sales offers

To benefit from a sales offer having been sent to him, the customer will have to indicate and validate his “promotional code”, in the granted field, on the page of Basket.

Confirming of the order and payments

After reading the state of his order, and when all the wanted information will have been completed, the customer will have to choose the method of payment to confirm definitively his order. The orders are payable in euros by PayPal ( French or international bank card) or bank transfer. It is specified that by making an immediate settlement by bank card, the customer will be tipped over then automatically on the server electronic banking of the platform of secure payment. This platform is subject to SSL (Secure Socket Layer) encryption so as to protect all the data bound to means of payment, and which at no time the banking data of the customer will pass in transit on the computer system of GREEN’ING . As soon as he confirms his payment, the order is registered. The order form will be registered on the computing registers of GREEN’ING and will be considered as proof of the contractual relations intervened between the Parties. According to the article 6 below, the customer has a right of retraction and refund, during a deadline of fourteen working days as from the date of reception of products by the customer

Confirming receipt of the order

A summary of the order will display once the validated order. This summary of order will be also sent by e-mail to the customer in the minutes which follow his purchase. The customer will have then access in the ” follow-up of his order ” by clicking on ” my account ” and by becoming identified by his e-mail address and his password.

Article 5 – Shipping

Delivery times and shipping method

Your orders are treated as soon as possible. Parcel are sent from reception of the payment. Once the handled order, it is delivered within 2 in 3 days by Coliposte (colissimo) or other carrier according to the country of destination. These deadlines get on in working days (except problem of mail delivery).

Delay / absence of delivery

In the case of a delay in delivery of more than 15 days, the customer will have to inform GREEN‘ING about it which will transmit the information in the Post office to start the opening of a investigation. This investigation can last until 30 days as from its opening. If during this deadline, the parcel is found, he will be immediately rerouted in the place of residence of the customer (in the majority of the cases). If on the other hand the parcel is not found at the end of the deadline of 30 days of investigation, Colissimo considers the parcel as lost. In this hypothesis, GREEN‘ING will send back to the customer a parcel of replacement, at its expenses. If one or several lost products were not available any more at this moment, GREEN‘ING would pay off to the customer the amount of these products.

Anomalies

Any anomaly concerning the delivery (damage, open parcel, damaged parcel, produced broken) must be necessarily indicated on the delivery slip in the form of “handwritten reserves”, accompanied with the signature of the customer. The customer will have to indicate immediately the anomaly so that a complaint is made with the carrier. GREEN‘ING will send back to the customer one or several replacing products, at its expenses.

Article 6 – Return and right of withdrawal

Right of withdrawal

The customer has a right of return of fourteen ( 14 ) days as from the reception of all of his order to retract without giving inevitably of motive. To exercise the right to withdraw, the customer has to notify his decision of retraction of his order by a deprived written declaration of ambigüité by specifying his name and first name, e-mail, address, number and date of order :

Refund

In case of retraction of the customer, GREEN‘ING will pay off payments received from the customer without excessive delay and, in any case, at the latest fourteen ( 14 ) days as from the day when GREEN‘ING is informed about the decision of retraction of the customer. In case of retraction of the customer on the global nature of its order, GREEN‘ING will pay off all of payments received from the customer, including the possible expenses of delivery. In case of retraction of the customer on a party of the products of the order, GREEN‘ING will pay off the amount of the returned products. The refund will be made by the same means of payment as the one that the customer used for his order or by bank check. GREEN‘ING can postpone this refund until reception and check of products.

Article 7 – Data protection

The piece of information of the name specific information collected within the framework of the remote sale is obligatory, this information being necessary for the processing and the delivery of the orders as well as for the issuing of invoices. This information is strictly confidential and are not transmitted in third parties. In accordance with the law relating to computers and freedom, the processing of the name specific information relative to the customers was the object of a declaration with the National Commission for Information technology and civil Liberties (CNIL) under the number of recording: 1805325. According to the article 34 of the law of January 6th, 1978, the customer has a right of access, modification, rectification and removal of data relating to him. To exercise this right, the customer can address a written request to GREEN‘ING.

Article 8 – Competent jurisdictions

The present contract is subject to French law. GREEN‘ING cannot be held responsible for damage of all kinds, so material as immaterial or physical, who could result from the misuse of the marketed products. In case of difficulties in the application of the present contract, the customer has the possibility, before any legal action, of looking for an amicable solution in particular by means of a professional association of the branch, the association of consumers or any other advice of his choice. The complaints or the challenges will always be received with attentive benevolence, the good faith being always presumed at the one who makes the effort to expose his situation. In case of dispute, the customer will address by priority the company to obtain an amicable solution. The Commercial court of Montpellier is only competent, whatever the place of delivery and the method of payment accepted.
